Breach of Contract
Did the contractor that you hired do a negligent or “shoddy job”, or even worse, did he run off with your money? Did you pay for something, and didn’t receive anything for it? If the amount is under $35,000 there is a chance that you can get it back. You need to file a Plaintiff’s claim outlining what happened and proving how much you spent. It should be detailed outlining what happened, why it happened, include affidavits and the complete evidence.

Small Claims Court is one of the busiest courts in Ontario for civil disputes. This is the court that allows individuals to take action against contracts being broken, or for monies owed, property being damaged, breach of contract, personal injury, and other damages and losses or monies owed to you.
Starting in January 2020, the maximum amount that a personal can claim for damages and financial losses will be $35,000.00.
These are some examples of Small Claims Court Matters:
- You loan someone money for a period of six months and he refuses to repay;
- A tenant is evicted from your rental unit, and creates or leaves damages amounting to thousands of dollars;
- A contractor does a poor-quality job, or even worse, never completes the job and has just taken your money;
- A product is delivered and the consumer refuses to pay for it;
- A “shady” door-to-door salesperson talks you into buying a furnace on an installment plan by misrepresenting himself.
When someone brings forth a claim for damages in Small Claims Court, it may be for either liquidated damages or unliquidated damages, or both. Liquidated damages are for the set amounts owed due to a contract being broken, a loan that was never paid, or an invoice that was not paid. Alternatively, unliquidated damages are difficult to assess, and are assessed by the Court for such things as lost wages.
When you have a claim in Small Claims Court, it is important that you have the documents, you are able to put forward the proper statements, and have all the evidence to support your case.

Once you finish the Court process and receive a judgment; it is not a guarantee of payment. If the debtor fails to pay, you may have to take steps to “enforce” or collect that judgment. For you to be able to collect, the debtor must have
- money,
- assets that can be sold, or
- a debt owed to the debtor by another
- person (for example, a bank account or employment income) that can be garnished.
